Terms of trade
1. Product Purchases
1.1. All furnishings and décor products, once confirmed and purchased for a client, are non-refundable, and only certain products may be eligible for exchange.
1.2. No return, refund or exchange will be accepted on a custom ordered item, which includes reupholstered or specially manufactured items.
1.3. By accepting a quotation, the client is confirming approval and acceptance of all products details inclusive of dimensions, design, quality and comfort, whether explicitly detailed or not. It is the client’s responsibility to ensure they have carefully considered the items suggested or recommended and included on a quotation, particularly custom made products, which are non-returnable.
1.4. The handling fee is not refundable on any item that might be returned or exchanged.
1.5. Any reimbursement or refund will be strictly done on the same basis as is provided for by the product supplier, and Nicky Slement Interiors will not be liable for any reimbursement other than what is provided for by the supplier.
1.6. Pricing for product, interior installation or other services not performed by Nicky Slement Interiors cannot be guaranteed and is sometimes subject to change. Quotation acceptances and payments should be done promptly to minimise the risk of price fluctuations, or changes in product availability which are beyond the control of Nicky Slement Interiors.
1.7. The client assumes the full ownership and risk of any product ordered.
2. Product Care, Use and Wear and Tear
2.1. It is the clients responsibility to ensure appropriate care when using, maintaining or cleaning any item purchased or supplied by Nicky Slement Interiors, especially fabrics, carpets and rugs. Certain fabrics are non-washable, or naturally settle, shrink or fade. Nicky Slement Interiors will not be liable for any changes to any product purchased that result from use, maintenance, cleaning or wear and tear.
2.2. Nicky Slement Interiors will assist client to resolve any clear manufacturing or factory fault on any product, with the relevant vendors or suppliers, on behalf of the client.
2.3. It is the Clients responsibility to ensure they are familiar with the necessary details for proper care, use and maintenance of all products purchased through Nicky Slement Interiors.
3. Consulting on Fixtures and Finishes
3.1. Any consulting on fixtures and finishes, or structure advice is provided as guidance and design concept and direction on the look and feel, and aesthetics of the items being assessed. This advice is in no way to be interpreted as an expert opinion on the appropriateness of the design concept or direction, and the necessary experts should be consulted by the client for both for the final decision and execution of the design concept.
3.2. Any advice or design concept given relating to the layout or design of any fixtures and fittings, such as lighting and power point positioning, cabinetry layouts and designs, flooring, window treatments or anything else discussed as part of a project, once accepted or implemented by the client is considered the choice of the client and NS will not be held liable for any issues or resulting dislikes or execution faults, from the design concept.
3.3. It is understood that NS is a décor and design service provider, and is not an expert in any architectural, construction, lighting, plumbing or installation function therefore cannot be held ultimately liable for any errors, faults, preferences, flaws or changes to these resulting from her décor and design advice.
3.4. It is the client’s responsibility to ensure that any items recommended as design choices for fixtures are fit for purpose and appropriate for the given application, technically or practically.
3.5. The appropriate service provider and product supplier would need to be consulted, and will be responsible for the implementation of the design concept, in conformance with any and all industry standards and regulations. NS will not be liable for any issue arising from materials being used outside of recommended specification, for any installation or implementation issue arising from design concepts being incorporated into any aspect of a project, nor for any.
3.6. NS will not be responsible for the services offered by contractors or consultants, nor will offer a warranty pertaining to their work; this includes no liability for NS for the quality of their works, materials used, their performance, nor their duration of works. Where necessary, the client is advised to enter into a direct agreement with the contractor or consultant. NS will only be able to assist the client in supervising that the work conforms to the design concept.
4. Other
4.1. Client will reimburse Nicky Slement Interiors for any out of pocket expenses, including but not limited to postage, storage, courier and travel costs.
4.2. Client agrees to allow Nicky Slement Interiors to photograph the project, and consents to the photos being used as part of Nicky Slement Interior’s design portfolio. The location and address of the client’s house, and the client’s name will not be disclosed, unless agreed to by the client.
4.3. Client is responsible to ensure insurance coverage for all furnishings and materials during handling, movements, and installation, and all aspects of the project.
